1.1 These terms constitute an agreement between users and xMeet products (hereinafter referred to as "xMeet" or "we") regarding the use of our products or services. "User" refers to any individual or organization that registers, logs in, or uses our products.
1.2 The services refer to those we provide to users under this agreement, including conversations, Q&A sessions, etc.
1.3 Without conflicting with this agreement, users shall comply with other relevant regulations regarding product usage and privacy in app store agreements.
1.4 To provide you with better services, before launching and using xMeet software and related services, please carefully read and fully understand all contents of this agreement. Pay special attention to clauses regarding liability exemption or limitation, rights licensing and information usage, consent to activate and use specific services, as well as applicable laws and dispute resolution. Particularly, we have highlighted exemption or limitation clauses in bold for your special attention.
1.5 If you are under 18 years old, please do not use xMeet software and related services.
1.6 If you do not accept this agreement, xMeet will be unable to provide you with complete products and services. In this case, you may choose to stop using them. By voluntarily agreeing to and using xMeet software and related services, you are deemed to have fully understood this agreement and agreed to be bound by it and other relevant agreements/rules (such as xMeet Privacy Policy).
2. Service Content2.1 Users need to register and authenticate with a mobile number to obtain an xMeet account before using our services.
2.2 xMeet provides product features including virtual agent connections, diverse conversations, achievement systems and considerate customer service to ensure smooth and pleasant user experience.
2.3 xMeet strictly complies with laws like Personal Information Protection Law to protect your privacy comprehensively. Your personal information involved in service usage, such as name and contact details, as well as personalized recommendations, are processed according to clear regulations. Please refer to Privacy Policy for detailed protection measures.
2.4 xMeet authorizes you personal, revocable, non-transferable, non-exclusive and non-commercial legal use of xMeet software and related services. Unauthorized rights belong to xMeet and require written permission for exercise. Non-exercise doesn't constitute waiver.III. Service Usage Rules
3. Service Usage Rules3.1 Content published by users through our services doesn't represent our views, and we assume no responsibility.
3.2 Users must not use false identity information during registration, shall properly keep account and password secure, and bear losses caused by leakage. If account theft is discovered, notify us immediately. We reserve rights to take measures like freezing accounts without liability unless otherwise required by law.
3.3 Users are not allowed to use this software or service for the following activities, otherwise their account will be banned:
3.3.1 Violating laws and regulations, including:
1) Opposing fundamental constitutional principles. Endangering national security, leaking state secrets, subverting state power, undermining national unity.
2) Damaging national honor/interests, inciting ethnic hatred/discrimination, undermining ethnic unity, insulting/misusing heroic images, denying heroic deeds, beautifying wars of aggression.
3) Undermining national religious policies, promoting cults/superstitions. Spreading rumors, disturbing social order, promoting obscenity/pornography/gambling/violence/murder/terrorism or abetting crimes.
4) Inciting illegal assemblies, associations, marches, demonstrations or gatherings disrupting social order.
5) Defaming others, infringing privacy, violating others' legitimate rights.
6) Containing other information prohibited by laws/regulations.
3.3.2 Unfriendly conversations, including:
1) Personal attacks and insults.
2) Discriminatory remarks targeting groups by nationality, region, gender, gender identity, sexual orientation, race, disease, religion, disability, etc.
3) Cursing, intimidating or threatening others.
4) Disparaging others' personal morality, viewpoints, qualities or abilities.
5) Sarcastic comments, derogatory remarks about others' content, or offensive vulgar language.
6) Prejudiced remarks about groups by nationality, region, gender, gender identity, sexual orientation, race, disease, religion, disability, etc.
3.3.3 Malicious remarks, including: meaningless codes affecting reading experience. Malicious circumvention using variants/homophones to bypass detection.
3.3.4 Other illegal acts infringing others' rights, interfering with normal operation, or unauthorized by xMeet.
3.4 Users must properly keep account information/passwords secure and bear responsibility for theft. Users are legally responsible for all activities under their accounts and must not use others' accounts/passwords.
3.5 Without xMeet's written permission, no one may reproduce, collect, edit or develop applications using xMeet's content (images, text, electronic information, etc.), or interfere with normal operations like disrupting services, promotions or customer support.
3.6 To terminate xMeet account services, you may apply for account cancellation if meeting following conditions:
1) You can only cancel your own account following xMeet's procedures;
2) You remain responsible for your actions during service usage before cancellation;
After successful cancellation, account records/functions cannot be recovered.
4. Intellectual Property Statement4.1 Intellectual property rights of content in xMeet software/services (software, technology, images, audio, video, etc.) belong to xMeet. Unauthorized use is prohibited.
4.2 You warrant that content published using xMeet (excluding personal information) is original or authorized, not infringing others' rights. For infringements, you shall bear liability and compensate losses. You authorize xMeet reasonable use of your content to improve services. Some features may allow others to use your content. If disagree, please refrain from use.
4.3 We strive to protect your personal information, but please avoid uploading personal information-related content to prevent inconvenience. 4.4 xMeet provides technical support for development/operation and owns all data/information generated during software/service development/operation within legal scope.
5. Legal Liability5.1 Users shall comply with "Legal Liability" provisions in store agreements unless conflicting with this agreement.
5.2 Upon discovery or reports, xMeet may review/delete violating content including user profiles/chat records, and take measures like warnings/bans against violating accounts while notifying users.
5.3 You understand/agree xMeet may punish violations, take legal actions, preserve information and report to authorities without liability. For violations, xMeet may warn, stop transmission, delete content, etc. without liability for resulting losses. xMeet may announce handling results and decide whether to restore accounts. For suspected illegal acts, xMeet will preserve records and report to authorities without restoring deleted content.
5.4 You understand/agree that consequences from violating laws/agreements are your responsibility, including compensation, unrelated to xMeet. For infringing xMeet/others' rights, you bear full liability/losses.
6. Advertising and Promotions6.1 You expressly consent to receive commercial information about products/services from us/third-party partners via announcements, emails, SMS, account notices or registered communication tools, with reasonable frequency (no more than twice daily).
6.2 If unwilling to receive relevant ads, you may select "Not Interested" to reduce similar ads.
6.3 If unwilling to receive push notifications, you may disable them in phone system settings.
6.4 Unless required by law, we may provide links to other websites without responsibility for their content/ads/products. We declare no liability for infringing linked content (unless legally required). If unable to understand/exempt xMeet's liability, please refrain from registration/use.
7. Disclaimer7.1 You understand/agree that xMeet may modify/interrupt/suspend/terminate software/services for operational/security needs.
7.2 You understand/agree that conversations/messages/services provided by automatically generated virtual agents are based on existing algorithms/technologies. While xMeet strives to provide services, due to technological limitations and various factors (force majeure, government actions, pandemic control, laws/regulations, technical risks, third-party service defects, etc.), xMeet continuously improves but doesn't guarantee:
i)Any express/implied warranties (fitness, ownership, non-infringement, etc.);
ii) Services meeting your requirements or completely avoiding discomfort/harm;
iii) Uninterrupted/error-free services meeting your expectations anytime/anywhere;
iv) Correction of all errors/defects;
v) Service feedback fully complying with your moral/religious beliefs.
xMeet reminds you that due to technology's objective nature, our software/services may inevitably contain offensive language/feedback without intentional infringement. If unable to fully understand above or unwilling to exempt xMeet's liability, and aware of assuming risks when using services, we sincerely advise against registration/use.
7.3 You understand/agree that when using xMeet software/services, displayed virtual content (e.g., virtual agents/conversations) mainly based on algorithms/content libraries belongs to xMeet. If unacceptable, please refrain from registration/use. xMeet may handle/delete/display your virtual agents and modify service rules anytime. 7.4 xMeet's rights to handle illegal content under this agreement don't constitute obligations/commitments, and xMeet cannot guarantee timely discovery/handling of violations.
7.5 xMeet isn't liable for indirect/consequential/punitive/incidental/special damages including lost profits. Unless required by law, xMeet's liability won't exceed fees you paid (if any).
7.6 This agreement's core purpose is ensuring strict compliance with national laws/regulations, maintaining social order/morality, and protecting user rights. While xMeet strives for accurate/reasonable judgments based on laws/regulations within its capabilities, due to technical/informational/objective limitations, judgments may not fully align with judicial/administrative authorities'. You acknowledge/agree to bear such consequences without xMeet's liability.
8. Minor Usage Terms8.1 If you're under 18, please don't use xMeet software/services.
8.2 Please comply with National Youth Network Civilization Convention:
(1) Learn online properly, avoid harmful information;
(2) Communicate honestly/friendly, don't insult/deceive others;
(3) Enhance self-protection awareness, don't casually arrange online meetings;
(4) Maintain network security, don't disrupt order;
(5) Benefit physical/mental health, don't indulge in virtual space.
9. Others9.1 You acknowledge that xMeet may conduct platform/equipment maintenance causing reasonable service interruptions without liability, with prior notice.
9.2 Headings are for convenience only and don't affect provisions' meanings/interpretations.
9.3 You and xMeet are independent entities. This agreement doesn't constitute xMeet's explicit/implied warranties/conditions, nor establish agency/partnership/joint venture/employment relationships.
9.4 To provide better services or due to legal/technical/functional changes, xMeet may amend this agreement with revisions forming part hereof. Updated versions will be published with advance notices. Continued use constitutes acceptance. If disagree, please stop using immediately.
